EMERGING LOTUS LLC – TERMS & CONDITIONS

By booking or purchasing any retreat, yoga teacher training, digital course, or related service from Emerging Lotus LLC (“Emerging Lotus,” “we,” “our”), you agree to the following Terms & Conditions. Please read carefully.

 

 

1. BOOKING & DEPOSITS

 

  • A non-refundable deposit is required to secure your space.

  • Deposits are non-refundable because they cover administrative costs, planning, and early reserved expenses.

  • A 24-hour grace period applies after booking; cancellations within this period will receive a full refund, including deposit.

  • After 24 hours, all deposits are final and cannot be refunded for any reason, including illness, travel disruptions, or emergencies.

 

 

2. BALANCE PAYMENTS & DEADLINES

 

  • Full payment is due no later than 40 days prior to program start (for October 10, 2025, this is September 2, 2025).

  • Failure to pay the remaining balance by the deadline will result in forfeiture of reservation and deposit.

  • Travel insurance is strongly recommended to protect your investment.

 

 

3. CANCELLATION & CREDIT POLICY

 

  • All deposits remain non-refundable.

  • If you have paid your balance in full and cancel more than 40 days before program start:

     

    • 75% of all payments beyond the deposit will be issued as credit toward another Emerging Lotus program (retreat, training, or digital offering).

    • Credit must be used within 12 months of the original program start date.

    • The remaining 25% is forfeited.

  • If you cancel within 40 days of the program start, all payments are forfeited.

  • Travel insurance is the only protection for non-refundable deposits, balances, medical emergencies, or other disruptions.

  • Participants are solely responsible for securing their own travel insurance and must handle all claims directly with their provider.

 

 

4. EMERGENCY CANCELLATION (BY EMERGING LOTUS)

 

  • If Emerging Lotus must cancel due to illness, emergency, or other unforeseen events:

     

    • You will receive a full refund of program fees paid to Emerging Lotus (excluding travel, flights, or accommodations).

    • Participants must use their travel insurance to cover all other costs, including airfare, accommodations, and related expenses.

    • Emerging Lotus is not liable for any indirect losses, including lost wages or additional travel costs.

  • If the hosting venue (e.g., Oak Tree Inn) cannot operate due to natural disaster, closure, or other causes, participants must handle all claims through travel insurance, as Emerging Lotus is not the venue operator.

 

 

5. LIABILITY & MEDICAL DISCLAIMER

 

  • All activities, including yoga, hiking, cold water immersion, and excursions, are undertaken at your own risk.

  • Emerging Lotus programs do not provide medical advice, diagnosis, or treatment.

  • Participants should consult a licensed physician before beginning any wellness, diet, or exercise program.

  • Emerging Lotus LLC and its teachers are not liable for injuries, medical conditions, or decisions made based on program content.

  • A separate Liability Waiver and Participant Conduct Policy must be signed electronically before attending.

 

 

6. JURISDICTION & DISPUTE RESOLUTION

 

  • All agreements with Emerging Lotus LLC are governed by the laws of Ohio, USA, regardless of program location.

  • Any disputes must first be addressed through good-faith negotiation.

  • If unresolved, both parties agree to non-binding mediation or arbitration in Ohio, USA, before pursuing legal action.

  • Participants remain responsible for addressing any issues directly with third-party vendors (hotels, transportation, excursions).

 

 

7. ACCOUNTABILITY & GRIEVANCE PROCESS

 

  • Emerging Lotus LLC is a registered Yoga Alliance school.

  • Participants may contact Yoga Alliance directly for concerns regarding school or teacher conduct, separate from these Terms & Conditions.

  • This process does not limit any rights or remedies under applicable law.

 

 

8. INTELLECTUAL PROPERTY & CONTENT USE

 

  • All retreat materials, training manuals, course recordings, and intellectual property are the property of Emerging Lotus LLC.

  • Participation does not grant permission to reproduce, distribute, teach, or profit from these materials outside of personal study.

  • Participants may not replicate Emerging Lotus program structures or run competing retreats at the same venue within 12 months without written permission.

 

 

9. SITE USE & PAYMENT PROCESSING

 

  • All payments are securely processed via Stripe through Wix.

  • Emerging Lotus LLC is not liable for payment processor errors, delays, or disputes, though we will assist in good faith.

  • Users agree not to misuse, scrape, or resell site content.

  • Emerging Lotus LLC is not liable for technical downtime, third-party issues, or indirect losses arising from site or system interruptions.

 

 

10. ACCEPTANCE OF TERMS

 

By completing a booking, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
